Mutual consent divorce under Section 13B of Hindu Marriage Act requires both spouses to agree on divorce, maintenance, child custody, and property division. The process involves filing a joint petition, a 6-month cooling period (which can be waived in certain cases), and a second motion hearing before the decree is granted.
When a cheque is dishonoured, the payee must send a legal notice within 30 days demanding payment. If the drawer fails to pay within 15 days, a criminal complaint can be filed within one month. The punishment includes imprisonment up to 2 years and/or fine up to twice the cheque amount.
The Protection of Women from DV Act, 2005 provides various remedies including protection orders, residence orders, monetary relief, custody orders, and compensation. The court can also pass interim orders for immediate relief to the aggrieved woman.
